 West Bengal: Calcutta High Court gave a big blow to Mamta government, know which decision refused to reconsider

West Bengal: The difficulties of the Mamta government are not taking the name of lessening. The Calcutta High Court has dealt a blow to the Mamta government. In a major setback to the state government, a division bench of the Calcutta High Court dismissed a review petition seeking reconsideration of the old judgment, directing the state government to clear pending Dearness Allowance (DA) dues to the employees within three months. was given. 

On May 20, a division bench of Calcutta High Court Justice Harish Tandon and Justice Rabindranath Samant directed the state government to clear pending DA dues to state government employees within the next three months. However, the state government filed a review petition in the same bench along with a petition to reconsider the decision. On Thursday morning, the same division bench dismissed the review petition and on May 22 upheld its earlier order in the matter. Meanwhile, the original petitioner in this case has filed a contempt of court petition in the Calcutta High Court against the state government. The next hearing on the contempt of court petition will be on November 9.

Sangh president Shyamal Kumar Mitra said, "After the first order on May 20, we wrote a letter to the state government to cooperate with us and clear the pending DA dues, as per the court's direction. However, the state government ignored our call. So now we will launch a big agitation against the state government in support of our demands."

SAT gave instructions to the state government in July 2020

In 2016, state government employees had filed a petition in the SAT demanding 32 per cent dearness allowance as per the recommendations of the Fifth Pay Commission. The petition was filed by the Confederation of State Government Employees. After a protracted legal battle, the SAT had, in July 2020, directed the state government to pay dearness allowance to its employees at par with their counterparts in the central government. The state government challenged that order in the Calcutta High Court.
